01Scope and relationship with other documents
This Policy applies to Freelancer Membership, Freelancer Membership - 1 Year, Freelancer Membership - 2 Years and any Separate Service expressly identified in a written quotation. It does not create a refund right for a service supplied independently by a Partner Service under that provider's terms. This Policy forms part of, and should be read together with, the Terms of Service.
The quotation must identify the selected product, term, price, VAT, included and excluded items, payment schedule and any product-specific cancellation terms before payment. Where a signed quotation gives a more favourable refund right, the more favourable term applies. Mandatory rights under UAE law always apply.
02What the customer purchases
Payment is for the selected Membership and the services expressly stated in the quotation. It is not a payment to purchase employment, a job, salary, government approval, sponsorship, a visa, a work permit or another official document.
A Membership may include Platform access, member benefits, onboarding, work-authorisation administration and, for the residence-inclusive Memberships, applicable employment, residence, medical, Emirates ID, insurance and sponsorship administration. These components may be delivered at different stages.
Golden Residency support and Mission Work Permit support are Separate Services unless the quotation expressly includes them within another purchase.
03Definitions used for refunds
"Membership Activation" means the date on which Membership or Platform access is activated, as identified in the Membership Documents.
"Work Started" means that we have begun an agreed eligibility review, document review, onboarding, account setup, contract preparation, client or assignment registration, application preparation or another material service step.
"External Amount" means a government, Authority, insurer, medical, Emirates ID, municipality, typing, courier, translation, banking, payment-processing or other third-party amount.
"Completed Component" means a Membership or service component already supplied, activated, submitted or completed.
"Recoverable Amount" means an amount returned or not yet committed by an Authority or third party and not earned for a Completed Component.
04How to request cancellation
Send a written cancellation request to support@dynamicfreelancer.ae or through the support method available in your account. Include your full name, Membership or invoice reference, contact details and reason for cancellation.
The effective request date is the date on which we receive a clear written request. A request does not immediately cancel an official application, work authorisation, employment arrangement, residence sponsorship, insurance policy or client assignment. Those items require separate offboarding or Authority steps.
05Cancellation before acceptance or work begins
If you cancel before we accept the Membership or Separate Service and before Work Started, we will refund the amount paid. We may deduct only a payment-processing amount that was disclosed before payment and that the payment provider does not return to us, to the extent permitted by law.
If we determine during the initial review that you are not eligible and Work has not Started beyond that initial review, we will refund the amount paid less any expressly disclosed and agreed eligibility-assessment charge, if applicable.
06Cancellation after work begins but before activation or external submission
If you cancel after Work Started but before Membership Activation and before an External Amount is committed or paid, we will refund the amount paid after deducting the reasonable value of documented work already completed. We will provide a written breakdown of the deduction.
The quotation, Membership Documents, service documents or cancellation schedule supplied before payment may identify a fixed onboarding, assessment or withdrawal amount that becomes earned when the relevant stage is completed. Any such amount must be disclosed before payment and will reflect the work and costs incurred at that stage. We will not deduct an undisclosed amount or charge for work that was not performed.
07Cancellation after Membership activation
After Membership Activation, the value allocated in the quotation to activated Platform access, onboarding and other Completed Components is not refundable, except where required by law or where we fail to provide the applicable component and do not correct the failure within a reasonable period.
Any amount allocated to a component that has not started, been activated, been committed or been supplied will be reviewed for refund after deducting applicable External Amounts and other Completed Components. Access already used does not create an automatic right to a full or pro-rata refund of the Membership term.
If the quotation does not allocate the price by component or stage, we will calculate the deduction reasonably by reference to the work completed, access supplied and costs committed, and will provide the calculation in writing.
08Government and third-party amounts
An External Amount becomes non-refundable only when it has been validly committed or paid and the relevant Authority or provider does not return it. If an External Amount is returned to us, we will pass the Recoverable Amount to you after applying any lawful and disclosed adjustment.
We will identify External Amounts and their status in the refund calculation. A cost is not treated as non-refundable merely because it is described generally as a government or third-party fee.
10Cancellation by Dynamic Freelancer
We may cancel or suspend an application, Membership or Separate Service where required by law or an Authority, or because of non-payment, false information, ineligibility, unlawful activity, security risk, material breach or failure to complete required steps.
The refund treatment will depend on the reason and stage reached. Completed Components and non-recoverable External Amounts remain payable where the cancellation results from your breach or ineligibility. If we cancel for our convenience or because we cannot provide an agreed component for reasons within our control, we will refund the amount paid for that undelivered component and any uncommitted External Amount.
11Two-year Memberships, instalments and renewals
Freelancer Membership - 2 Years is one Membership for the stated two-year term unless the quotation expressly divides it into separate annual components. Early cancellation does not automatically create a pro-rata refund for the remaining months. Refunds are assessed by the stages, components and costs identified in this Policy and the quotation.
An instalment plan changes when payments are due but does not divide the Membership into monthly purchases. Amounts due for Completed Components or committed costs remain payable after cancellation.
A renewal is treated as a new term for refund purposes. A Membership does not renew automatically unless you expressly agree to automatic renewal in writing. You should notify us before renewal work or external commitments begin if you do not wish to continue.
12Offboarding and official cancellations
Membership cancellation and official cancellation are different processes. Ending or not renewing Platform access does not automatically cancel employment, work authorisation, residence sponsorship, Emirates ID records, insurance or an Authority file.
You must cooperate with required offboarding, transfer, cancellation, final payroll, client, insurance and Authority steps. Any applicable cancellation, overstay, absconding, transfer, medical, courier or other external charge must be disclosed or supported before it is charged. Refunds may be held only to the extent reasonably necessary to settle amounts properly due under the applicable documents and law.
13Separate Services
A Separate Service is subject to the milestones and third-party costs in its quotation. Golden Residency and Mission Work Permit support are eligibility and application-support services. Payment does not guarantee eligibility, Authority approval, issuance or timing.
If a Separate Service is cancelled, we will deduct Completed Components and non-recoverable External Amounts and refund the balance. Any special non-refundable assessment or professional fee must be identified before payment.
14How approved refunds are calculated and paid
We will provide a written decision showing the amount paid, Completed Components, External Amounts, other permitted deductions and approved refund. You may ask for clarification or provide information relevant to the calculation.
Approved refunds will normally be returned to the original payment method. Where that is not possible, we may request a verified bank account in the payer's name. We aim to initiate an approved refund within 15 working days after the amount is agreed and any information needed to process it is received. Bank, card or international transfer times are outside our control.
VAT will be adjusted through the appropriate credit note or tax process. Exchange-rate differences, correspondent-bank charges or card-provider charges outside our control may affect the amount received where the original payment or refund involves another currency.
15Non-refundable amounts
Subject to applicable law, the following are not refundable to the extent they have been properly incurred, supplied or earned:
- Completed Components;
- External Amounts validly committed or paid and not returned by the recipient;
- approved translation, notarisation, attestation, courier, medical, insurance, banking or similar work already supplied;
- documented additional costs caused by inaccurate information, missed appointments or a breach within your control; and
- payment-processing amounts that were disclosed before payment and are not returned to us.
A discount, promotion or bundled price does not by itself make the whole purchase non-refundable. The same stage-based assessment applies unless a lawful, clear and specifically agreed promotional condition provides otherwise.
16Consumer rights
Nothing in this Policy excludes a refund, repeat performance, price reduction, compensation, complaint right or other remedy that cannot lawfully be excluded under UAE law. If a clause conflicts with a mandatory legal right, the mandatory right applies.
17Changes to this Policy
We may update this Policy to reflect changes in law, Authority processes or the Membership model. The version accepted for your purchase applies to that purchase unless a later version gives you a more favourable right or a change is required by law.
